BOXNUC7I3BNK Recognizes EVO 970 as Legacy and not UEFI

Got a new BOXNUC7I3BNK NUC Kit.  Only using a Samsung EVO 970 M.2 ssd.  The bios recognized the drive as an M.2 ssd, but

in the boot panel, does not recognize it as a UEFI drive, only as a Legacy drive.

 

I updated to the most recent Bios, followed an Intel support article 000022600 (5-11-18) for Windows 10 system. 

Item 3 sub item C says to "On the Boot > Boot Configuration menu, in the UEFI boot pane, OS Selection is set to

Windows 8.x/Windows 10".  My Bios does not have an OS Selection option in the UEFI boot pane.

 

Please tell me I am missing something.
